Housing statute


I: Preamble and purpose

"Housing is recognized for the quality of being a good and a basic need of public interest, and therefore it will be protected by a protection and maintenance statute that will be mandatory to comply with both by owners, tenants or residents of the same ones at any modality".
Therefore, home protection principles will be established beyond being a mere property and use of it.

II: Rights and Obligations

Both owners and their subsidiary residents will have the obligation to keep it in good conditions of habitability and state of conservation.

II A: Owners:

1.- The owners will have the previous obligation to maintain the good state of condition and conservation, with which they will preserve the advantages and protection for their exclusive use, or assign it to third parties, according to their wishes, needs and will at all times.
2.- Abandonment (due to lack of use) together with carelessness and serious deterioration of the same on the part of its owner, will make you lose protection (according to regulations) of rights of use over it.
3.- Every owner has the right to visit his property periodically (under the norm or stipulated period) to check the state of maintenance of it (if he so wishes).

II B: On third parties: tenants, residents, etc.

Every tenant or inhabitant of a house will have to have by contract or documentary justification the permission of its owners to stay in it.
1.- Every inhabitant of a living place, in addition to needing documentary justification to live in it, will have the obligation to keep it in a good state of use, in such a way that the serious deterioration of it due to its misuse or lack of protection of it , is sufficient reason for the cancellation of its use and the forced abandonment of it in a minimum established period.
2.- The damage caused by the misuse or manifest destruction of the home will be financially responsible for immediate compensation with the repair of the damage, or if it is not done or cannot be done, it will be a crime penalized with the pressure that corresponds to him, in addition to the immediate eviction of the same, and loss of acquired rights.
--The damages produced in the previous case will be claimed in full, even after the eviction or abandonment of the house.
--Therefore, defenselessness cannot occur, since the responsibility for serious and responsible deterioration of the home will always be punished financially or criminally.
3.- Only the maximum respect and maintenance of the home, may make its residents (non-owners) creditor of perks and benefits of extension of contracts, subsidies, aid and municipal compensation for this extension of contracts, etc.


Estatuto de la vivienda.

I: Preambulo y finalidad
"A la vivienda se le reconoce la calidad de ser un bien y necesidad basica de interes publico, y por tanto estara protegida por un estatuto de proteccion y mantenimiento que sera obligatorio de cumplir tanto por propietarios, como inquilinos o moradores de la misma en cualquier modalidad".
Por tanto, se estableceran principios de proteccion de la vivienda mas alla de ser una mera propiedad y uso de la misma.
II: Derechos y Obligaciones
Tanto propietarios como sus moradores subsidiarios tendran la obligacion de mantenerla en buenas condiciones de habitabilidad y estado de conservacion.
II A: Propietarios:
1.- Los propietarios tendran la obligacion anterior de mantener el buen estado de la vivencia, con lo cual conservaran las ventajas y proteccion para su uso exclusivo, o ceder este a terceros, segun sus deseos, necesidades y voluntad en cada momento.
2.- El abandono (por falta de uso) unido al descuido y deterioro grave de la vivencia por parte de su propietario, le hara perder proteccion (segun normativa) de derechos de uso sobre la misma.
3.- Todo propietario tiene derecho a visitar su propiedad periodicamente (bajo norma o periodo estipulado) para comprobar el estado de mantenimiento de la misma (si asi lo deseara).
II B: Sobre terceros: Inquilinos, moradores, etc.
Todo inquilino o morador de una vivienda tendra que tener por contrato o justificacion documental el permiso del sus propietarios para permanecer en ella.
1.- Todo morador de una vivencia, ademas de necesitar la justificacion documental para vivir en ella, tendra la obligacion de mantenerla en buen estado de uso, de tal modo que el deterioro grave de la misma por su mal uso o falta proteccion de esta, es razon suficiente para la cancelacion de su uso y el abandono forzado de la misma en un periodo minimo establecido.
2.- Los destrozos producidos por el mal uso o destrozos manifiestos de la vivienda seran responsabilidad economica de inmediato resarcimiento con el arreglo de desperfecto, o en su caso si no se hace o no se puede hacer, sera un delito penalizado con la presion que le corresponde, ademas del inmediato desalojo de la misma, y perdida de derechos adquiridos.
--Los destrozos producidos en el caso anterior, seran reclamados en toda su extension, aun despues del desalojo o abandono de la vivienda.
--Por tanto no podran ocurrir la indefension, pues la responsabilidad por deterioro grave y responsable de la vivienda sera castigado siempre economicamente o penalmente.
3.- Solo el maximo respeto y mantenimiento de la vivienda, podran hacer acreedor a sus moradores (no propietarios) de prebendas y beneficios de ampliacion de contratos, subsidios, ayudas y compensaciones municipales para esta ampliacion de contratos, etc.
